He brought some breaded meat with him to eat during the flight, but neither he nor the other passengers consumed all the food before landing. He left the remaining of the food in a bag in plain sight on board the aircraft, with the intention of throwing it away.Upon his arrival, two Canada Border Services Agency officers greeted Mr. Hershkovitz. He completed his customs declaration and did not indicate that there was food on board the aircraft. The officers issued a Notice of Violation for importing an animal by-product without declaring it, contrary to subsection 16(1) of the Health of Animals Act with a penalty of $1,300. Mr. Hershkovitz signed and paid a penalty reduced by 50%. By doing so, he acknowledged committing the violation,as per subsection 10(2) of the Agriculture and Agri-Food Administrative Monetary Penalties Act.6 Hershkovitz v.
